Primo, owner of the Website www.primo.mt (hereafter the “Website”), is a company that offers a delivery service to local, independent restaurants (“Restaurant Partners”) that prepare the food (referred to below as “we”, “us” or “Primo”). Created and registered in Malta, with an office located at 68, Waterfront Place, Suite 1-2, The Strand, Sliema, SLM 1022.
2. Accessing Services
We grant temporary access to both our Site and Service, or `Services and reserve the right to amend or withdraw access without prior notice required.
If our Site or Services is unavailable at any given time or for any duration, we will not be held liable, for any reason. For selected parts of our Site or Services, restricted access may be given to those who are registered users. Registered users are solely responsible for the confidentiality of log-in details and passwords, as well as any activity that is related to their account. For any concerns regarding passwords, or if you suspect misuse, we encourage you to contact customer support immediately and inform us as soon as this occurs. We maintain the ability to deactivate your account at any time.
3. Acceptable Use
You may engage our Services strictly for lawful purposes, without breaching applicable local, national or international laws or regulations. You may not upload, download, send, knowingly receive or re-use any material that goes against our content standards (Section 5). You must also agree not to gain Site or Services access without prior given consent from someone in authority. Nor must you interfere, disrupt or damage any part of our network or equipment which is used to deliver our Services.
4. Site Features
We do not take the decision to interfere with an interactive service lightly. Although from time to time we must endeavour to remove content that lies in breach of our content standards. If we have to moderate, then you will be advised before using the Service.
5. Content Standards
These standards are applicable to all “Contributions” (in part or in whole), that you make to our Services, as well as any material and interactive services related to it. We request cooperation and compliance to remain within the spirit of the standards laid out below:
Contributions must comply with all applicable laws, including ones from where the Contributions have originated.
If facts are stated, Contributions must be accurate.
Contributions must not contain any defamatory, hateful, obscene, offensive and derogatory material. It must also not contain explicit material, the promotion of violence or discrimination.
It must not invade another’s privacy, be used to impersonate, or be of any inconvenience to any other person
Contributions must not advocate, promote or assist any unlawful act, including, but not limited to, infringement of copyright material, misuse of computers and misrepresentation.
6. Suspension and Termination
We reserve the right to take any of the below actions:
Issuance of warnings
Legal action for reimbursement towards all costs burdened resulting from the breach
Immediate, temporary or permanent removal of Contributions or uploaded material, including, but not limited to, the withdrawal of your right to make use of our Service or Services.
Advising and disclosing any information deemed relevant to law enforcement authorities.
This is a non-exhaustive list and other forms of action may be undertaken.
7. Intellectual Property Rights
Excluding Contributions from our users, we own the licensee of all intellectual property rights related to our Site and Services and protected by worldwide treaties and copyright law. All such rights are reserved. You may only make use of our content for your own non-commercial and personal use.
8. Posted Information
We will not be held liable for any reliance on information and materials contributed to our Site or Services.
9. Frequent Changes
Our aim is to consistently do better. This means that from time to time, technology and content may need to be updated. Suspension of access to our Site or Services may need to occur, though we remain under no obligation to maintain updates to material.
We have endeavour to undertake great care with the preparation and development of our Site or new Services we may provide. If any omissions or errors are noted in relation to content or technical difficulties, we are not to be held liable. We will ensure to attempt and correct problems as soon as we’re able to once we’re informed by our esteemed customers.
We will not uphold any liability in relation to loss or damage which either yourself of a third party may incur through our Site, future Sites or any Services related to us. This in no way affects our liability for any fraudulent misrepresentation, or misrepresentation in any sense, or any other liability which cannot be excluded under applicable law.
11. Visits and Uploading
We maintain the right to use any information or material uploaded to our Services for any purpose related to our business. It will be considered non-proprietary as well as non-confidential. To the degree that material is protected by intellectual property rights, you grant us license to use the material as we deem appropriate.

Sometimes we add links in our posts or pages citing resources and other sites. We do not accept any responsibility in relation to these and are not liable for any loss or damage that may occur if you choose to use them.
13. Applicable Law
The Maltese and European courts will maintain jurisdiction for any claims arising from the use of our Site or Services.

These Terms and Conditions may be amended and revised at any given time. It is your responsibility to check this page once in a while to remain informed of any changes made.
